Formbreaker Terms of Use

The short version: Formbreaker is a one-time purchase you may use on your own Apple devices. It is a game, sold as-is, with no accounts, and no online service beyond Apple’s optional Game Center leaderboards. Your save file lives on your device and we cannot recover it for you.

These Terms of Use (the “Terms”) are an agreement between you and Christopher Sotomayor (“we,” “us”), the developer of Formbreaker (the “Game”). By downloading or using the Game you accept these Terms. If you do not accept them, do not use the Game.

1. Licence

We grant you a personal, non-transferable, non-exclusive licence to use the Game on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service and the Usage Rules in them. This licence is for your own non-commercial entertainment. You may not sell, rent, redistribute, or sublicense the Game, and you may not copy it except as the App Store allows.

2. What you may not do

• Reverse-engineer, decompile, or disassemble the Game, except to the extent that applicable law expressly permits it despite this restriction.
• Remove or alter any copyright or ownership notices.
• Redistribute the Game’s art, music, code, or text as your own work.
• Use the Game in any way that breaks the law where you are.

3. Your save file

The Game stores your progress on your own device. We have no copy of it and no access to it. If you delete the Game, reset your device, or lose your device, your progress is gone and we cannot restore it. We are not responsible for lost progress, and the Game may reset progress if the save file is damaged or edited.

4. Ownership

The Game, including its code, art, music, characters, world, and story, is our property and is protected by copyright and other laws. These Terms give you a licence to play it, not ownership of it. Apple and iPhone are trademarks of Apple Inc.

5. No warranty

The Game is provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not promise the Game is free of errors, or that it will run on every device or every version of iOS. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

6. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for lost data or lost progress, arising out of your use of the Game. Where liability cannot be excluded, it is limited to the amount you paid for the Game. Nothing in these Terms limits any right you have that cannot be waived under the law where you live.

7. Health and comfort

The Game contains moving shapes, flashing effects, and screen shake. If you are prone to photosensitive seizures, motion discomfort, or eye strain, play in a well-lit room, sit back from the screen, and take a break every half hour. Stop playing and consult a doctor if you feel dizzy, nauseated, or disoriented, or if you experience altered vision, twitching, or loss of awareness.

8. Price, updates, and availability

The Game may be updated, changed, or withdrawn from sale at any time. Purchases, refunds, and billing are handled by Apple under the App Store Terms of Service; we cannot issue refunds. Updates are delivered through the App Store and may change or remove features.

9. Apple’s role in these Terms

Because the Game is distributed through the App Store, the following apply:

• These Terms are between you and us only, not with Apple. Apple is not responsible for the Game or its contents.
• Maintenance and support for the Game is our responsibility, not Apple’s. Apple has no obligation to furnish any support.
• In the event the Game fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Game.
• We, not Apple, are responsible for addressing any claims relating to the Game, including product liability claims, any claim that the Game fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• We, not Apple, are responsible for the investigation, defence, settlement, and discharge of any third-party intellectual property claim that the Game infringes that party’s rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

10. Changes to these Terms

We may update these Terms when the Game changes. The date at the top shows the current version, and continuing to use the Game after an update means you accept the revised Terms.

11. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules, except where the law of your own country of residence must apply.
